Portuguese Law 62/2011: Patent infringement and dispute resolution on medicines

The IP Federation has written to the British Embassy in Portugal, requesting that every effort is made to influence the Portuguese government to effect the removal of Law 62/2011 in favour of a Law/legal system for enforcement of IP rights that is applicable in all technical fields (including pharmaceuticals).

The system should be operated by a state court and in this regard the specialised IP court has been communicated to be operational in Portugal. It is imperative that the new Law/legal system for enforcement of IP rights is compliant with National, Union and International Legislation and agreements.
