European Commission Call for Evidence – Review of the Copyright in the DSM Directive

The European Commission has launched a Call for Evidence as part of its review of the 2019 Copyright in the Digital Single Market Directive (DSM Directive).This comes at a critical moment, as innovation increasingly relies on data analytics and use of AI.

The IP Federation supports the EU’s balanced text and data mining (TDM) exception and recognises that the right copyright framework is necessary to enable innovation, investment and growth across all sectors of the economy. Getting this framework right will be essential to support not only creators, but also the many sectors that rely on access to and use of content, such as technology, cybersecurity, research, healthcare, manufacturing and services.

The current review, including its focus on AI, licensing, piracy and research, provides an important opportunity to ensure that the EU’s copyright framework continues to deliver for the full ecosystem: enabling the responsible development of new technologies and fostering the conditions for economic growth and competitiveness across the European economy.

The consultation closes on 25 June 2026.
