Intellectual Property Bill 201314: Second Reading

The IP Federation, along with CIPA (the Chartered Institute of Patent Attorneys) and ITMA (the Institute of Trade Mark Attorneys), welcomes the adoption by the Government of the amendments to the Intellectual Property Bill. These amendments, which were championed by the three organisations, spell out the Government’s stated intentions, by limiting the criminal offences to deliberate copyists and to close copies – protecting legitimate competitors who have gone far enough to make new designs in their own right, and giving the criminal courts a test they will find easier to apply.

Furthermore, we support strongly David Willetts and Viscount Younger in opposing the possible extension of criminal sanctions to UDR (unregistered design right) infringements.

The Intellectual Property (IP) Bill was given its second reading in the House of Commons on 20 January 2014, having completed its Lords stages last year. Among other provisions, the Bill includes the introduction of a criminal sanction for intentional copying of registered designs. The Government’s intention is to deter those who knowingly copy UK registered designs. CIPA, ITMA, the IP Federation and others have successfully pushed for an amendment to make sure that criminal charges could only be brought against those involved in deliberate and close copying.
