Criminal sanctions for Registered Design infringement IP Federation response

The IP Federation has issued a policy paper in response to the provision for criminal sanctions for infringement of Registered Designs proposed in Clause 13 of the Intellectual Property Bill 2013–14.

The IP Federation continues to oppose strongly the proposed introduction of criminal sanctions for registered design infringement. The scenarios set out in our policy paper illustrate a number of unintended and damaging consequences of creating such criminal sanctions.

If, however, we are required to have criminal sanctions for registered design infringement, to mitigate the risks to reputable business, we are proposing a number of amendments to current Clause 13 .

We continue to be even more firmly against the possible extension of criminal sanctions for unregistered design right infringement.
