Consultation on Reform of the UK Designs Legal Framework

The IP Federation has submitted a response to the consultation on Reform of the UK Designs Legal Framework closing 2 October 2012.

In the Federation’s view, criminal penalties for deliberate infringement of registered design rights are unjustified by evidence, and in any case could not be made to work without unintended bad consequences. The Fed­eration encourages the remedying of law enacted in the CDPA 1988 (ap­plying unregistered design right to functional designs) which has proved dysfunctional and which creates legal disharmony in the EU and in­deed an unlevel playing field to the disadvantage of UK manu­facturers.
