IP Federation submissions on draft UPC legislation

The IP Federation has responded to the consultation comprising a Technical Review and Call for Evidence on Secondary legislation implementing the Agreement on a Unified Patent Court (UPC) and EU Regulations establishing the Unitary Patent. Responses were requested by the IPO’s UPC Taskforce by 2 September 2014.

We have addressed the twenty individual questions in the consultation document, and made some generalised remarks on the following topics:

JURISDICTION

  • Bringing national law into line with the UPC
  • Transitional provisions – interpretation of Article 83 UPCA (see Annex)
  • Jurisdiction of UK IPO
  • Technical drafting issues

UNITARY PATENT

  • Threats provisions
  • Double patenting

INFRINGEMENT

  • Software interoperability – Article 27(k) UPCA
