IP Federation note to the UPC Preparatory Committee

On the Draft Rules of Procedure of the Unified Patent Court (UPC), the IP Federation has sent a note to the Preparatory Committee of the UPC. We are requesting our paper to be considered by the Rules Group before finalising the 17th draft. In particular, our members ask the Preparatory Committee to consider and adopt our comments on the draft rules, namely:

•    simplify Rule 14;
•    address the bifurcation gap issue;
•    give the Court broader dispute management powers;
•    introduce flexibility for completion of the interim procedure and the length of oral hearings; and
•    make it clear that the Court of Appeal has the power to grant per¬mission to hear procedural appeals.
